India’s Supreme Court reaffirms death penalty for ‘diabolical’ assailants in 2012 fatal gang rape

Over five and a half years after the 2012 Delhi gang-rape case shook the conscience of the nation, the Supreme Court will decide Monday whether the four men responsible for this heinous crime must be hanged.

On July 9, 2018 SC will decide the fate of the four accused of death sentence in the Nirbhaya gang-rape case.

The trial court referred the case to the Delhi High Court for confirmation of their death sentence.

A bench comprising Chief Justice Dipak Misra and Justices R Banumathi and Ashok Bhushan rejected the review pleas filed by Mukesh (29), Pawan Gupta (22) and Vinay Sharma (23), saying no grounds have been made out by them for review of the verdict. Over the next few days, his brother Mukesh Singh, gym instructor Vinay Sharma, fruit seller Pawan Gupta, a helper on the bus Akshay Thakur, and the 17-year-old juvenile, who can not be named, are arrested.

The Supreme Court today rejected an appeal for a reduced sentence and reaffirmed the death penalty for the accused in the rape and murder of a medical student in Delhi in 2012.

Interestingly, the committee was opposed to the death penalty as a punishment - even in the rarest of the rare cases. "Until then, neither Nirbhaya nor the other daughters of the country will get justice".


She also said that their faith in the judiciary has been reinstated.

On 16 December 2012, the six convicts raped and brutalised the student in a moving bus she had boarded in South Delhi with a male friend. Her friend was beaten severely, and both were thrown out of the bus at a secluded spot.

The case put the treatment of women in India in the global spotlight and led to heavier sentences for sex crimes.

The woman died of internal injuries almost two weeks later in a Singapore hospital.

The convicts still have the option to file a curative petition in the Supreme Court and send mercy petitions to the President of India. Of six assailants eventually arrested, the fifth man died in prison in 2013 and the sixth was a juvenile who served his three-year sentence in a youth offender facility. Hanging a few men will not change the manner in which women are affected by sexual violence in their daily lives.

The fourth did not appeal, but his lawyer said they would soon file one, according to the Press Trust of India news agency.
