"Immigrant New Yorkers like Pablo Villavicencio provide for their families by working hard and making sacrifices, they shouldn't be ripped from their communities and their crying children for pursuing the ever dimmer American dream", he said.

In a letter to the ICE office in NY, the Democrat said Villavicencio's "expedited removal serves no legitimate public safety objective and the circumstances leading to his arrest and detention raise serious legal and policy concerns".

Pablo Villavicencio was taken into custody after a background check at the garrison revealed he was wanted for immigration law violations. The Army said he signed a waiver okaying a background check, and an active Immigration and Customs Enforcement warrant was discovered.

Natalia Aristizabal of Make the Road New York called Villavicencio "a man who wants nothing more than to stay with his wife and daughters".

Chica, who was born in Colombia and moved to the US a decade ago, said she is a USA citizen.

Villavicencio showed a New York City identification card, also known as IDNYC, as he had done during previous deliveries.

The trouble for Villavicencio, who had been living with his family in Long Island, started because a new soldier was at the gate that day.


Villavicencio, who is married and has two daughters who are US citizens, agreed in 2010 to voluntarily depart the country after an immigration judge ordered him to depart the U.S.

"Please do the right thing with my husband for my family". He's the main support, so we're really going to suffer if he's deported. This time, however, they rejected it.

UPDATE: Reached for comment, Richard Azzopardi, a spokesperson for Governor Cuomo's office, tells Gothamist, "We are in contact with Pablo's family and have offered legal and other supportive services free of charge". An ICE spokeswoman said he was "illegally present" in the country after he had been granted voluntary departure by an immigration judge in March 2010.

"As such, his voluntary departure order became a final order of removal", she said.

Details about the suit were first reported by the New York Times. He slammed the detainment as an "outrageous affront" to NY values. Brooklyn City Councilman Justin Brannan said.

Republican Rep. Dan Donovan, whose district includes the base, called criticism of the arrest "just more insanity". He showed his New York City identification card to the guard as he had done several times before, but the base said in a statement that he didn't have the proper identification, so he had to get a daily visitor pass.

Also on Friday, Gov. Andrew Cuomo sent a letter to the Department of Homeland Security in Villavicencio's defense, demanding an investigation into the practices of Immigration and Customs Enforcement agents.
