Missouri State Highway Patrol Sergeant Bill Lowe says Officer Michael was able to return fire hitting McCarthy.

Noble told police he threw the rifle into a body of water, and on Thursday led investigators to the site, according to an affidavit filed in Henry County Circuit Court.

At that point, police claim Noble 'acted visibly upset and faked crying'. Police say they told Noble that he already knew the answer to that question.

Police say Noble asked what type of weapon was used in the murder of Michael.

Noble initially told two officers who visited his home on Thursday that he bought the rifle and sold it to McCarthy. As police were leaving, they say they asked Noble if he knew where the weapon was now located.

As Michael exited his vehicle in downtown Clinton, the alleged shooter also got out of his auto and fired once at the officer before fleeing the scene and crashing his vehicle into an embankment about four blocks away, Lowe said.

But Noble then "changed his story" and said McCarthy had asked him to buy the weapon for him. Police then made contact with McCarthy, taking him into custody without incident.

Lowe earlier said that a gun had been found in a creek about two miles north of Clinton. He then went with officers to the intersection of NW 300th Road and NW 131st Road.

The prosecutor said he's considering more charges against Noble and whether to seek the death penalty against McCarthy.

McCarthy is in jail and being held without bond, accused of murdering Officer Michael at about 10:45 p.m. Sunday, August 6th. Investigators told ABC News Monday that Michael initially pulled over the driver because the vehicle's headlights were off, and once Michael ran the plates, he discovered the vehicle's plates were also expired.
