Trump U. Lawsuit Judge Curiel Assigned to Dreamer Deportation Case

Trump pledged to end DACA during the 2016 campaign, but the Department of Homeland Security has continued issuing permits. But in February, Montes was approached by a suspicious Customs and Border Protection agent.

Cases involving DACA recipients could signal the Trump administration's plans for the program, which was established in 2012, Johnson said.

It turns out that Curiel will continue to resolve Trump-related disputes. Prior to all of this, Montes had been re-approved for DACA status through 2018.

The Department of Homeland Security reversed itself Wednesday, acknowledging that a young man who was deported to Mexico had valid protective status in the USA, despite its earlier claim.

The problem, though, is on the part of the story both sides agree on: Montes tried to sneak back into the U.S. on February 19 and was caught by Border Patrol.

Montes arrived in the United States illegally at age 9 with his family.

The National Immigration Law Center, which represents Montes, stood by its account.

In a statement, the Mexican government said it had been in contact with Montes to offer assistance and called for an investigation to ensure Border Patrol acted properly. The Department of Homeland Security says it has no record of that encounter, but say they deported Montes after he was caught trying to re-enter the country illegally.

"That situation is evolving right now", Spicer said.

The Department of Homeland Security says its policies on DACA have not changed. His lawyers acknowledged in the lawsuit that he had a misdemeanor on his record and "minor traffic offenses", none of which would have disqualified him from DACA.


The agency also disputed another fact of Montes' case, regarding when he entered the country.

"I was forced out because I was nervous and didn't know what to do or say, but my home is there", said Montes in a statement released by his lawyers. "We will see them in court". He was then cleared for DACA four years later.

Announced by the Obama administration in June 2012, DACA allows eligible immigrant youth who were brought to the U.S.as children to live and work here temporarily.

"But the DACA situation is a very, very - it's a very hard thing for me, because, you know, I love these kids", he told reporters. Instead, he detained Montes, and had him deported within three hours.

"The promise that our government made to all the DACA recipients, including Juan Manuel, is at stake", Preciado said. Attorneys are now suing to find out what exactly happened.

House Minority Leader Nancy Pelosi went further, calling the report "appalling". One dreamer in San Jose is now terrified about her future.

One supporter of the move, though, was hardliner Rep. Steve King, a Republican from Iowa who supports vastly restricting the flow of immigration into the U.S. and has a history of controversial statements about immigrants.

Juan Manuel Montes, 23, is the first so-called DACA "DREAMer" to be deported under President Trump's administration.

The attorneys said in a lawsuit filed Tuesday in the Southern District of California that their client left the country February 17 only because he was stopped by a law enforcement official and asked for identification while walking to a taxi stand in Calexico, California, about 120 miles (190 kilometers) east of San Diego.
